The petitioner herein has sought direction against the respondent authorities to demonstrate as to what action they have taken pursuant to the statement made before this Court in Criminal Writ Petition No. 1426 of 2020 and further direct them to act upon the Proposal No. 3 of 2021 submitted by the District Magistrate, Bhusawal against Prakash Nikam. 2.

The prayer clause (B) is totally misconceived. It is seen that the respondent - authorities had not made any such statement. On the contrary, learned counsel for the petitioner in the said petition had made a statement that the proposal of externment has already been forwarded to the Superintendent of Police, Jalgaon and had therefore, sought leave to 1 / 2

915-WP-1756-22.odt withdraw the petition. The criminal writ petition was disposed of as withdrawn without any further directions. Hence, there is no question of issuing any direction against the respondent authorities as sought in prayer clause (B). The respondent-authorities herein have already issued directions as sought. Moreover, the petitioner is not an aggrieved person. His right much less fundamental rights, are not infringed. Hence, the petitioner has no locus to seek such writ.

In view of above, the criminal writ petition has no merit and thus stands dismissed.
