After hearing learned counsel for both sides and when this Court has shown inclination to cause interference in the order, learned counsel for contesting respondent, on instructions, submits that instead of passing order on merit the order impugned may be set aside. He further makes statement that even on remand no order would be sought against the petitioner as there is no application against the petitioner. 2.

In view of the above, petition is allowed. Impugned order is set aside. The matter is relegated back to State Information Commission to consider the same a fresh.
