Mr Bhavar, learned Counsel appearing on behalf of the petitioner submitted before us that the petitioner, by way of present writ petition challenges the order dated 11th December, 2013, passed by the Presiding Officer, Debts Recovery Tribunal, Aurangabad as well as notice issued to the petitioner, dated 1st September, 2015. He further submitted that in view of the appropriate statutory remedy available to the petitioner, he be permitted to approach the Debts Recovery Appellate Tribunal by filing appropriate proceedings/appeal.

In view of above, the present petition is disposed of with liberty as prayed for, subject to law of limitation, in case the petitioner fails to approach appellate tribunal within reasonable period after disposal of the present writ petition.
