CORAM : S.G. MEHARE J.
DATE : 17.01.2023.
PER COURT :- 1.
Heard the learned counsel for the applicants and learned A.P.P for for respondent-State.
2.
The applicants are seeking bail on the ground that trial has not opened. However, the learned Sessions Judge, Ahmednagar has observed that one witness was examined. Now, the learned A.P.P would submit that already three witnesses are examined. The grievance of the applicants is that the complainant is unnecessarily protracting the trial by filing one application after another. Therefore, the trial has been unnecessarily stalled. Considering the progress in the trial, the applicants have no case for bail. However, the
929- B. A. No. 2061-2022.odt learned trial Court is directed not to allow any person including the complainant to protract the trial without justifiable reason. The trial should be conducted strictly as per the law.
3.
With the above observations, application stands disposed of.
