The learned counsel for the applicant submits that in view of the compromise decree passed in RCA No.190/2002, which has now attained finality, in terms of the paragraph no.2 of the said compromise, the applicants and his other two brothers namely Ramesh and Suresh are entitled for the compensation in equal shares. Learned counsel for respondent no.2 has not disputed this legal position.

In view of the above and for the reasons stated in the application, the application is allowed in terms of prayer clause 'B', at present.
