The Petitioner is the Deputy Education Officer, aged 54 years. Recovery of amount has been initiated on the ground that excess payments were made earlier.

The learned Advocate for the Petitioner submits that a representation dated 02-05-2023, is pending with the CEO, Zilla Parishad, Osmanabad, seeking re-consideration of the said

Considering the request of the Petitioner, this Writ Petition is disposed off. Let the Zilla Parishad, Osmanabad deal with the representation of the Petitioner by considering the law laid down by the Hon'ble Supreme Court in the case of Sayyad Abdul Quadir VS State of Bihar, (2014) 8 SCC 883 and State of Punjab and Others Vs Rafiq Masih ( White Washer) and others, (2015) 4 SCC 334.
