In view of the ratio laid down by the Supreme Court in Mallikarjun Kodagali (Dead) vs The State Of Karnataka, reported in 2019 (2) SCC 752, no leave is required to be sought if the appeal is preferred by the victim, in terms of provisions of Section 372 of Cr.P.C.

Accordingly, we direct the office to register the appeal and place it before us for hearing.

The learned A.P.P. seeks time to comply with the directions given in the order dated 23.9.2021.
