Learned counsel for the petitioner states that the proposal seeking approval to the appointment of the petitioner as Lab Assistant has been forwarded by the Headmaster to the Respondent No.3 on 31.10.2012, however, no decision has been taken on the same.

Mr.Ghute Patil, learned Asstt. Govt. Pleader states that if the same is pending, then the said proposal would be decided as law. 4.

In light of above, we pass the following order : a) The Respondent No.3 - Education Officer (Secondary),

Zilla Parishad, Aurangabad, shall decide the proposal submitted by the Headmaster of Respondent No.4 seeking approval to the appointment of petitioner as a Lab Assistant, if not already decided on its own merits as per law expeditiously and preferably within four (4) months.

b) The Writ Petition is disposed of. No costs.
