ORDER:

On the last date, we had directed the respondent No. 2 to personally remain present if the instructions are not given to the learned Assistant Government Pleader. Learned Assistant Government Pleader submits that, he has only received the letter from the respondent No. 2 requesting him to seek time. When the specific order was passed, respondent No. 2 was duty bound to remain present in the court in the event the instructions are not given on the merits of the matter.

We place the matter on 26.03.2018. On the said date, if the respondent No. 2 does not remain present in the Court, we would be constrained to issue non-bailable warrant against him. 3.

Stand over to 26.03.2018.

At the time of rising, the learned Assistant Government Pleader mentions the matter and submits that the respondent No. 2 was present in the Court No. 1 and states that now he is present before this Court. Respondent No. 2 - Mr. Vikas Rajaram Mane, SubDivisional Officer, Beed is present in the Court. The learned Assistant Government Pleader, on instructions of the said Sub-Divisional Officer, states that the acquisition proceedings are complete and award would be passed within two weeks from today. The said statement is accepted.

In view of the aforesaid statement, the earlier order directing the respondent No. 2 to personally remain present on the next date is recalled.
