IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 663 OF 2015 Shailendra Phulchand Vishwakarma ..
Petitioner
Versus
The State of Maharashtra & others ..
Respondents Mr. D.R. Jayabhar, Advocate for the petitioner. Mr. S.S. Tope, A.G.P. for respondent/State.
Mr. A.V. Hon, Advocate for respondent No.6.
CORAM : A.V. NIRGUDE & A.M. BADAR,JJ.
DATED :
23.06.2015 P.C. :- 1.
Heard. Learned Counsel for the petitioner upon instruction from his client makes a statement that his client will not press this petition for challenging the correctness of order of Scrutiny Committee rejecting his claim for Nomadic Tribe, by name, "Gadi Lohar". The petitioner until recently was taking education in the college run by respondent No.6. The petitioner's advocate also stated that the petitioner is ready and willing to
( 2 ) wp663.15 furnish an undertaking to the Court giving assurance to the Court that he will not claim any benefit based on his claim that he belonged to "Gadi Lohar - Nomadic Tribe". After such undertaking is given to the Court, the purpose of this petition would be over and the petition would be disposed of. However, it is made clear that disposal of this petition would not absolve the petitioner from the liability arising on account of fees payable to the college. With the result, respondent No.6 shall issue necessary degree passing certificate, upon the petitioner clearing the dues/fees etc.
2.
The writ petition accordingly stands disposed of.
