Mr. Sapkal, the learned counsel submits that, the issue involved in the present writ petition is no longer res-integra in view of the judgment of the Division Bench of this Court in Writ Petition No. 8985 of 2011 with other connected writ petitions dated 9th May, 2014. According to the learned counsel the petitioner stood retired on attaining the age of superannuation on 31.08.2008.

We have heard the learned Assistant Government Pleader also. The application seeking review of the said judgment dated 09.05.2014 is also dismissed.

In the light of the above, we dispose of the writ petition. The petitioner shall make representation to the respondent No. 1 for grant of benefit as per the Government Resolution dated 30th October, 2009 and the State Government shall pass order in that regard within a period of three (3) months from the date of receipt of said representation and upon finding eligible to petitioner, the State shall pay difference of pension and revised pension to the petitioner and same shall be paid within a period of three (3) months from the date of decision.
