1) The application is filed for condonation of delay of 790 days caused in filing application for setting aside the order made by the learned Registrar Judicial of refusal of registration. As office objections were not removed, registration is refused. Delay of 790 days is caused. Learned counsel for original plaintiff is present. He submits that there is possession decree in favour the present respondent, plaintiff. Only to protract the things such tactics are played by the original defendant, present
2 CA 15707/2015 appellant. In view of this statement, it is made clear to learned Advocate Shri. Narwade that on the next date the matter itself will be heard or admission purpose without considering the office objections.
2) So, the application is allowed. Delay is condoned. The order of Registrar Judicial is set aside and the matter is restored to its original number. Office to place the matter before the Court for admission purpose on 20th April 2016. Both the sides should be ready with the record which may be necessary for deciding the appeal or passing order for admission purpose. Undertaking is given by learned counsel Shri. Narwade in that regard.
