1] Heard learned counsel for the applicants, the learned APP for the respondent-State and the learned counsel for the respondent no.3.
2] The applicant is apprehending arrest in connection with Crime No. 0665/2024, registered at Gangakhed Police Station, District Parbhani, for the offences punishable under sections 64 (1), 64 (2) (m), 352, 351 (2), 351 (3), 3 (5) of the Bharatiya Nyaya Sanhita, 2023, Section 3 (1) (w) (i), 3 (1)(w)(ii), 3 (1)(r), 3(1)(s), 3(2)(va) of the S.C. & S.T.[Prevention of Atrocities] Act, 1989 and under Sections 4, 8 and 12 of the Protection of Children from Sexual Offences Act, 2012.
3] The learned counsel for the applicants submits that this Court, by order dated 21.11.2024, has granted interim protection in favour of the applicants for the reasons stated in the order. Thereafter, the applicants have attended the concerned police station and have co-operated with the investigation. The learned counsel for the applicants further submits that the Sessions Court has granted anticipatory bail in favour of the co-accused. 4] It is informed by the learned counsel for the respondent no.3 that the son of applicant no.1 has married with the complainant.
5] Considering that the applicants have attended the concerned police station and have co-operated with the investigation in terms of the interim order dated 21.11.2024. In view of above, the interim order dated 21.11.2024 stands confirmed, in the following terms : i] The applicants shall attend the concerned police station as and when required by the investigating officer.
ii] The applicants shall not tamper with the evidence of the prosecution in any manner. They shall not influence the informant, witnesses and other
persons concerned with the case. The applicants shall not involve in similar offences.
iii] The applicants shall co-operate with the investigation and also in the proceedings before the trial Court.
6] In the event, the applicants violate any of the conditions specified in this order, it shall be liable to be cancelled.
7] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.
8] The application stands disposed of.
