The parties have arrived at compromise. The applicant-original accused Appa Anna Dhotre and respondent No.1-complainant Shri Sambhaji Sonyabapu Saudagar, Branch manager of Adarsha Nagari Sahakari Patsanstha Limited, Bench Rahuri (Bk), Tq. Rahuri, District Ahmednagar, are present before this court. They have accepted the contents of compromise and their signatures on it. They are duly identified by their respective counsel. The contents of compromise are thus stand verified. The compromise terms are taken on record and marked "X" for identification.

In the light of above compromise, the order dated 8.2.2010 passed by learned J.M.F.C. Rahuri in S.T.C. No. 726 of 2006 and confirmed by the learned Additional Sessions Judge, Ahmednagar by

crvn55.16 -2order dated 23.5.2014 in criminal appeal No. 31 of 2010 is quashed and set aside. The applicant-original accused Appa Anna Dhotre is hereby acquitted for the offence punishable under Section 138 of Negotiable Instruments Act awarded in S.T.C. No. 726 of 2006. The fine amount, if paid by the applicant-original accused, shall be refunded to him.
