By this application, the applicant prays that the order dated 09.12.2013 passed by this Court be recalled and the Criminal Application is restored. Learned Advocate for the non applicant has strenuously opposed the application.

In the light of the above, and for the reasons set out in the application, the same is allowed. The order dated 09.12.2013 is, therefore, recalled and Criminal Application No.37 of 2007 is restored to the stage at which is was dismissed.

At the request of the parties, list Criminal Application No.37 of 2007 for admission on 11.07.2016.
