O R D E R

[ 30th November, 2024 ] .

The appellants / claimants are present alongwith their Advocate Mr. V. D. Bhise. Respective learned counsels for the acquiring body alongwith Ms. S. B. Korke, Executive Engineer, Jalna Irrigation Division, Jalna, are present.

Both the parties have arrived at compromise. The terms of compromise are placed on record. The same are taken on record and marked as 'X' for the purpose of identification. The parties have agreed that the acquiring body shall pay four times of the amount awarded by the Special Land Acquisition Officer or Rs.2,400/- per R for non-irrigated land, Rs.3,600/- per R for semi irrigated land, Rs.4,800/- per R for irrigated land and Rs.1,200/- per R for Pot Kharab land, whichever is lesser. The said amount is in respective cases. The amount be deposited in this Court within 18 months from today.

If the amount is deposited within 18 months from today, the claimants have agreed not to claim interest for the period of this 18 months. In case the amount is not deposited within 18 months from

today, the said amount shall carry interest as per the law. It is made clear that for the period of delay that is caused in filing the appeals, the claimants shall not be entitled to claim any interest as per law.

The interest be paid as per the judgment of Full Bench in case of State of Maharashtra Vs. Kailash Shiva Rangari, 2016 (4) ALL MR 513.

After the amount is deposited, the claimants shall be entitled to withdraw the said amount without requiring any formal application to that effect.

The appeals stand disposed of. The awards be prepared in terms of this order.

The civil application/s, if any, except the application to bring on record legal heirs, stand/s disposed off. The Court Fee refund Certificate be issued as per the Rules.
