IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.65/2015 Pravind Dinkar More.

...Petitioner..

Versus

The State of Maharashtra & others.

...Respondents...

.....

Shri Surendra V. Suryawanshi, Advocate for petitioner. Shri V.H. Dighe, AGP for respondent nos.1 & 2. Shri D.S. Bagul, Advocate for respondent nos.3 & 4. .....

CORAM: S. S. SHINDE & P.R. BORA, JJ.

DATE: 17.04.2015 ORDER :

1] Heard learned counsel for the parties.

2] Though the petitioner has good case on merits, however, the selection process is over. The selection list is also exhausted. The selection list, which was prepared, was supposed to operate and remain in force for one year. Secondly, the cut-off date mentioned in the Government resolution dated 30.12.2013 issued by the School Education and Sports Department, Mantralaya,

WP 65/15 - 2 - Mumbai, on which heavy reliance has been placed by the petitioner to forward the proposal, was 28.2.2014, which was extended till May, 2014.

3] For the aforesaid reasons, we are not able to grant any relief to the petitioner since the entire controversy relates back to the selection process, which was undertaken in the year 2012-13 and such selection list was to operate for one year thereafter.

4] Learned counsel appearing for the respondent nos.3 & 4, on instructions, makes a statement that new selection process is already in progress and if the petitioner applies, his certificate will be forwarded in the light of Government resolution dated 30.9.2013 of which reference is already made to the concerned authority well within time.

5] The writ petition is, therefore, dismissed. No order as to costs.
