Learned counsel for applicant submits that the President of the applicant who prosecutes the matters is an old man and is also suffering from paralysis and diabetes and is bed ridden. In the circumstances matter could not be diligently prosecuted. 2.

Learned counsel for respondent No.2 although shows his reluctance is not in a position to dispute veracity of the contents of the application.

In view of aforesaid, applications are allowed in terms of prayer clauses (A) and (B) subject to payment of cost of Rs.1500/- by applicant to respondent No.2 within a period of eight weeks from today.
