This is an application of wife who is custodian of a daughter, 15 years of age, seeking transfer of H.M.P. No.12 of 2014, from learned Civil Judge (Senior Division), Nandurbar to Family Court at Aurangabad, on the ground of hardship.

The non-Applicant, admittedly, is a resident of Ahmedabad. The ground of transfer alleged, is hardship particularly in the background of distance which is about 300 kilometers.

The non-Applicant has volunteered to pay travelling charges and other expenses if the proceedings at Nandurbar are continued.

939 mca.1.15.odt In view of above, it will be appropriate to reject the application for transfer with direction to the present non-Applicant to pay an amount of Rs.3,500/- (Rupees three thousand and five hundred only) on each date to the Applicant before the learned trial Court.
