IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD REVIEW APPLICATION (CIVIL) NO.240 OF 2018 IN WRIT PETITION NO. 11592 OF 2018 KALLINATH SHIVYOGI DHANGE

VERSUS

RAJENDRA ALIAS APARAO MDHUKARRAO VEDPATHAK AND OTHERS ...

Advocate for the Applicant : Shri A. D. Shinde ...

CORAM : RAVINDRA V. GHUGE, J.

DATED : 05th DECEMBER, 2018.

...

PER COURT :

1.

The review applicant points out that this Court (Coram : V. L. Achliya, J.) had passed an order on 24/04/2018 in Writ Petition No. 3972/2018, by which, RCS No. 69/2017 was expedited and was to be decided within six months. This order was not brought to the notice of this Court (Coram : Myself) when this Court passed an order on 19/10/2018 in Writ Petition No. 11592/2018. It is pointed out that in paragraph 17, this Court refused to expedite the hearing in the same RCS No. 69/2017 because it was lodged in the year 2017, as the earlier order was not pointed out.

937-ra-240-18 in wp.odt 2.

In view of the above, I find that this review application actually needs to be treated as a motion for 'speaking to the minutes' of the order dated 19/10/2018. It is, therefore, treated as such.

3.

In view of the above, paragraph 17 of the order dated 19/10/2018 would stand corrected and would read as under : '' Since the suit is lodged in 2017 and since this Court had earlier expedited the hearing of the suit by order dated 24/04/2018, the hearing of the suit shall stand expedited as per the earlier order passed by this Court''.

4.

The motion is, accordingly, disposed off.
