This is an application seeking condonation of delay of 160 days in filing the appeal against the judgment and order passed by the Family Court in a proceeding under Section 6 of the Hindu Minority and Guardianship Act, 1956.

Considering the fact that it is a custody matter, for the reasons mentioned in the application the delay is condoned. 4.

Register the Family Court Appeal. On such registration issue notice in the appeal. Learned advocate Mr. Chavan waives service of notice for the respondent in the appeal.

Since admittedly the child which is seven year old is in the custody of the respondent, she shall be brought to us for interaction on 09.10.2023 depending upon the exigency we will be hearing the matter finally on that day.
