By this application, applicant is seeking enlargement on bail in connection with Crime No. 0734 of 2021 punishable under Sections 326, 324, 323, 504, 506, 109 read with Section 34 of the Indian Penal Code registered with Karjat Police Station, Tal. Karjat, Dist. Ahmednagar. 2.
Allegations contained in the FIR against the applicant in short are that one Ankush Raghoba Janjire who is the adjacent owner of the land of the informant is threatening the informant to sell the land to the said Ankush Raghoba Janjire. The said Ankush Raghoba Janjire used to instigate the applicant to assault the informant and his son
Ganesh Dattatraya Potare.

It is further alleged that on 24th November, 2021 at 7.30 a.m. informant was proceeding on motorcycle No. MH-16 BW-9390. He was intercepted by applicant and two others. Informant was assaulted by the applicant and two others with kicks and fist blows. Applicant assaulted the informant by means of an iron rod. However, informant covered his head with his hand because of which the blow landed on his hand. Accused Lakhan stabbed the informant by means of a knife and accused Goverdhan delivered a blow of cable on the back and on the forelimbs of the informant. On these allegations FIR came to be lodged. 4.
I have heard learned counsel Shri. Deshmukh for the applicant, learned APP Shri. Narwade for the respondent State and Shri. Suryawanshi, learned counsel for the informant assisting APP.

Learned counsel Shri. Deshmukh for the applicant submits that applicant is not the person who is having land around the field of the informant. It is a cleverly drafted
complaint. Informant has been discharged from the hospital. No further complications are reported. He further submits that the applicant will stay away from the district itself. 6.
From the allegations in the FIR it is seen that the informant sustained injury on his hand. Medical certificate is produced. It shows that informant had injury on his head, both buttock, Right forearm. He had injury due to sharp object on left thigh. He was admitted in the hospital. 7.
Charge-sheet is not filed. Considering the seriousness of the injuries and investigation is pending, I am not inclined to release the applicant on bail. Hence the order.
