PER COURT :- 1.

The present application is filed for quashing the complaint First Information Report bearing Crime No.51/2015 registered with Cidco Police Station, Aurangabad for the offences under sections 420, 406, r/w 34 of the Indian Penal Code. It is stated that, the complainant and present accused, have settled the dispute and a memorandum of understanding has been executed between the parties (Exh.'C'). The complainant Dr. Anil Baliram Patil and accused Mohamed Ashfaq Kazi are present before the Court. They admit the contents of memorandum of understanding. They are identified by their respective counsels. The complainant accepts having received the amount as per settlement. Offences are economic in nature.

Considering the fact that matter is settled between the parties, the complaint First Information Report bearing Crime No.51/2015 registered with Cidco Police Station, Aurangabad for the offences punishable under sections 420, 406 read with section
