By this application, the applicant seeks suspension of sentence passed by the learned Additional Sessions Judge, Latur in Special Case (Atrocity) Case No. 2 of 2014.

The applicant accused is convicted by the Additional Sessions Judge, Latur by judgment and order dated 25.10.2016 in Special Case (Atrocity) Case No. 2 of 2014, under Section 354 of I.P.C. and sentenced to suffer R.I. for one year and to pay fine of Rs.2000/- i/d to suffer S.I. for one month and for the offence under Section 341 of I.P.C. and sentenced to suffer R.I. for one month and to pay fine of Rs.500/- i/d to suffer S.I. for seven days.

Learned counsel for the applicant accused submits that during

cran6444.16 -2the course of trial, the applicant accused was on bail and fine amount is deposited before the trial court.

Considering the above statement, the application is allowed. The substantive part of sentence, awarded by the learned Additional Sessions Judge, Latur by judgment and order of conviction dated 25.10.2016, sentencing thereby the applicant for the offences punishable under Sections 354 and 341 of I.P.C. stands suspended till disposal of the appeal and till then the applicant accused Hussain @ Dumma Maheboob Shaikh be released on bail, on furnishing personal bond of Rs.20,000/- with one surety in the like amount, on condition that the applicant shall attend the concerned police station once in a week on every Sunday, between 10.00 a.m. to 11.00 a.m. till further orders of this Court. Bail before the trial Court. Humdast allowed.
