Petitioner is praying for taking action against respondent no. 4 for raising illegal construction over plot no. 1 situate at Samta Housing Society, Latur. Petitioner also appears to be member of the said society. It is not the contention of petitioner that any esmentary right available to petitioner is violated as a result of raising construction by respondent no. 4. It would be open for the petitioner to avail of alternate remedy available in law for redressal of his grievance. It would also be open for the petitioner to pursue the planning authority for taking appropriate action against respondent no.
