It is an admitted fact that Behed Vividh Karyakari Seva Sahakari Society Limited, Behed was not added as party in the complaint for the offence punishable under section 138 of the Negotiable Instruments Act. The learned Judicial Magistrate First Class has inter-alia on this ground acquitted the respondents No. 1 and 2 i.e. the Chairman and the Secretary of the said Society.

On going through the material on record, in both the cases, no fault can be found with the reasoning forwarded by the learned Judicial Magistrate First Class. In the circumstances, both the present applications for grant of leave to file appeal are hereby dismissed.
