Neither the petitioner nor the respondents are in a position to place on record the panchanama, pursuant to which, the vehicle is seized. On the ground of illegal transportation of sand, the vehicle of the petitioner is seized. According to the petitioner, the vehicle is seized by unauthorised person. The seizure of the vehicle is after amendment to Section 48 of the Maharashtra Land Revenue Code. Even a person, below the rank of a Tahsildar, would be authorised to seize the vehicle. The petitioner has a remedy to file an appeal.

{2} wp1351819.odt In the light of that, writ petition is disposed of with liberty to the petitioner to file an appeal. All contentions are kept open. In case, appeal is filed by the petitioner, the appellate authority shall endeavour to decide the appeal expeditiously. No costs.
