CORAM : R. G. AVACHAT AND ABASAHEB D. SHINDE, JJ.

DATED : SEPTEMBER 30, 2025 P.C.:

CIVIL APPLICATION NO. 6408 OF 2024 :

1.

This is an application seeking production of certain documents on record.

2.

For the reasons stated in the Civil Application, Civil application is allowed in terms of prayer clause (B) of the Civil Application. 3.

Civil Application stands disposed of accordingly.

WRIT PETITIONS :

4.

The petitioners have placed on record some documents secured post filing of these Writ Petitions. Meaning thereby these documents were not before the Scrutiny Committee for appreciation while considering the claim of the petitioners.

5.

The documents are in the nature of revenue records of preconstitution and entry in the birth register as well. Since it is a factual matrix and needs to be gone into by the forum of the first instance, we remit all the matters back to Respondent No.2-Scrutiny Committee by setting aside the orders impugned with further direction to decide the petitioners' claim afresh after giving them full opportunity of adducing oral or document evidence.

6.

Respondent No.2-Committee to decide the claim of the petitioners within a period of three months from today. [ABASAHEB D. SHINDE, J.] [R. G. AVACHAT, J.]
