The proposal is submitted by the institution seeking approval to the appointment of the petitioner. It is submitted that the petitioner is appointed as Shikshan Sevak on higher secondary division from O.B.C. category to teach Geography subject.

It is submitted that even application is given by the institution seeking permission to fill in the post on 25.4.2016 and after waiting for two months, the advertisement is issued on 7.6.2016 and the petitioner is selected. Under order dated 7.10.2017, the Deputy Director of Education had communicated the institution that no objection certificate cannot be granted.

The Government Resolution dated 13th March 2018 is referred to wherein the clarification is made that appointments made after 2nd May 2012, the condition of seeking permission to fill in the post may not apply.

The Deputy Director of Education shall consider the proposal received by him seeking approval to the appointment of petitioner on its own merits, in accordance with law and shall consider the Government Resolution dated 13th March 2018 so also shall, after verifying his record about the receipt of application from the petitioner shall pass orders expeditiously, preferably within four months. 5.

Writ Petition disposed of. No costs.
