DATED : 25th March, 2015 PER COURT :- 1] Heard Shri G.G.Kadam, learned counsel for applicant, Shri A.V.Deshmukh, Additional Public Prosecutor for respondent no.1 and Shri V.A.Bagdia, learned counsel for respondent nos.2 and 3.

2] By the present application, the applicant, who is first informant is pressing for cancellation of regular bail granted to the respondents by the Additional Sessions Judge, Hingoli on 21.11.2014 for the offences punishablae under Sections 306, 498-A r/w 34 of the Indian Penal Code in connection with Crime No. 85 of 2014.

3] It is to be noted that the learned Sessions Judge, after evaluating the material available in the charge sheet found that respondent nos. 2 and 3 have made out case for grant of regular bail in their favour. From 21.11.2014 till date no incident is reported by the investigating agency or the first informant to show that the respondents have misused the opportunity granted to them.

crap7050.14 4] In that view of the matter, especially when after going through the charge sheet and after going through the impugned order, this court is of the view that the trial court has exercised discretion correctly in favour of the respondents warranting no interference by this court. 5] Hence, application is rejected.
