IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 11759 OF 2015 M/S ASHT BHUJA FIRE SAFETY AND MULTI SERVICES AND ENTERPRISES THROUGH ITS PROPRIETOR

VERSUS

THE STATE OF MAHARASHTRA AND ANOTHERS ...

Advocate for Petitioners : Mr. Rahul G. Joshi. AGP for Respondent Nos. 1 & 2 : Mr. P. S. Patil. Respondent No.3 served.

. . .

CORAM : A. V. NIRGUDE & V. L. ACHLIYA, JJ.

DATE : 31ST MARCH, 2016.

PER COURT:

1] This petition does not deserve admission. Petitioner is challenging the rejection of petitioner's bid regarding the supply of manpower etc. for the period of 11 months, invited by respondent no.2 and awarding of contract to respondent no. 3. The petitioner's bid was rejected on two counts viz. the petitioner-firm did not submit PAN card of the firm and it also did not possess sufficient experience. 2] The petitioner asserts that, both these reasons are not sufficient to reject its bid. We are not inclined to go into merits of the case mainly because, the work is already allotted to respondent no.3 and it has started the work in December 2015. We do not see

{2} wp11759.15.doc any mala fides in allotting the work to respondent no.3 and for rejection of the petitioner's bid as the same was on technical grounds.

3] Writ Petition stands rejected.
