Heard both the sides. The applicant who was successful in getting acquittal is now facing the burnt because of the pendency of appeal against acquittal for last almost 5 years.

The trial court while acquitting him had expressly stated that his saving bank account which was put on hold by the banker on instructions of the Investigating Officer would be unlocked for operation after the period of appeal was over.

The learned advocate for the applicant submits that in spite of such direction the bank is not permitting him to operate and consequently 1/2

66.Appln.4206.22.odt he solicited an order from the appellate court by moving application (Exhibit-6) and even that application is not being decided. 4.

We dispose of the application by directing the appellate court to decide the appeal finally as expeditiously as possible within six weeks or pass appropriate order on the application (Exhibit-6) within six weeks from today.
