Learned Advocate, Mr. Deshpande, holding for learned Advocate, Mr. Tambade, upon instructions, seeks withdrawal of the application. 2.

It will not be out of place to mention that on 09.07.2025, it was pointed out on behalf of applicant that whatever amount was stated in the F.I.R has been already paid by the applicant to the informant company however then it was pointed out by learned advocate for the informant company that by supplementary statement, the exact misappropriated amount was stated and that remaining amount has not been paid. Learned advocate for the applicant took instructions and submitted that if amount is remaining then the applicant 29 -Cri Appln-3901-2023.odt

is ready to pay the same within a period of 8 (Eight) weeks from that day. 3.

We contemplate the compromise and, therefore, kept the matter today that is by giving sufficient time but then now the withdrawal has been sought. Learned Advocate for Respondent No. 2 takes objection on the count of the fact that the applicant is absconding. 4.

The Police are at liberty to take the steps against the applicant by treating him as absconding after adopting appropriate procedure. 5.

In view of the statement made on behalf of the applicant, we dismiss the application as withdrawn.
