BENCH AT AURANGABAD.

WRIT PETITION NO. 813 OF 2016 PANDIT REKHAJI CHAVAN

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioners : Mr. Dambe Santosh S. AGP for Respondent/State : Mr. S.B. Yawalkar ...

CORAM : S.S. SHINDE & P.R. BORA, JJ.

Dated: February 29, 2016 ...

PER COURT :- The learned counsel appearing for the petitioner undertakes to deposit the deficit court fees within one week from today. 2.

In this Petition, the grievance is raised that, though the appeal is pending before the Respondent No.3 from the year 2012, the same is not decided. 3.

We do not appreciate the act of the petitioner to file the Writ Petition invoking extra ordinary jurisdiction. The petitioner ought to have approached the Respondent Nos. 1 and 2 for redressal of his grievance. Accordingly we grant liberty to the petitioner to file appropriate representation/application to the respondent Nos. 1 and 2 raising grievance of the petitioner. In case, such representation/application is filed, the respondent No.2 to take decision on the said application/representation, as expeditiously as possible, and preferably within four weeks from filing such application. 4.

The Petition is disposed of in above terms.
