2] Issue notice to the respondent - State. Learned A.P.P. waives notice.
3] By this application, the applicant/appellant is praying for suspension of the substantive
sentences awarded by learned Special Judge/Addl. Sessions Judge, Parbhani, in Special Case (Atrocity) No.26 of 2011 for the offences punishable under Section 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and Sections 323 and 504 of Indian Penal Code, directing him to suffer rigorous imprisonment for one year with fine amount; one month with fine amount; and six months with fine amount, respectively, for the said offences.
4] Fine amount has already been deposited by the applicant. Considering the fact that short term sentences are awarded against the present applicant by learned Special Judge, the substantive sentences of the present applicant, are hereby suspended, during pendency of the appeal.
5] The applicant/appellant be released on bail upon his executing P.R. bond in the sum of Rs.20,000/- (Rs.Twenty Thousand) and also upon furnishing surety in the like amount, during pendency of the appeal. Humdast allowed.
6] The application is allowed and disposed of accordingly.
