Heard learned counsel Shri. Kazi for the applicant. 2.

This application is filed for releasing the applicant on bail on medical grounds. The applicant has alleged in the application that he is suffering from blood cancer. Therefore, report from Superintendent Prison was called about the illness the applicant was suffering from. The Superintendent Prison has forwarded the report of Medical Officer stating therein that the applicant is suffering from Megaloblastic Anemia. Anemia is not a cancer.

Learned counsel Shri. Kazi submits that the applicant ba1747.21.odt

be referred to the Medical Board to find out as to what illness is suffering from. In the first instance, the applicant has not mentioned the source of his knowledge about he being suffering from cancer. There is no certificate on record to indicate that the applicant is suffering from cancer much less blood cancer i.e. Leukemia. Therefore, there is no occasion for referring the applicant to the Medical Board. Application is, therefore, devoid of any substance, hence rejected.
