Learned counsel for respondent No.5 submits that work order was issued to respondent no.5. The work is already completed and work completion certifcate is issued by the Sub Divisional Engineer, Public works, Sub Division, Parbhani. In light of that, no purpose would be served to consider the prayers of the petitioner.

If, according to the petitioner, his tender was wrongly rejected , the petitioner may avail remedy of damages or otherwise as may be permissible.

Writ petition disposed of. No costs.
