Learned counsel for the applicant submits that by common order this court has directed to remove the office objections within a stipulated period and since the said order was not complied with, writ petition came to be dismissed automatically. The learned counsel submits that, the applicant original/plaintiff is ready to remove the office objections forthwith.

Learned counsel for respondent no.5 has strongly resisted the application on the ground that there is an inordinate delay in filing the application for restoration and the same is not explained.

It appears that, the applicant is a poor agriculturist and he could not pursue the matter.

In view of the above and for the reasons stated in the application, application is allowed in terms of prayer clause B and C. Civil application accordingly disposed of. ( V.K. JADHAV, J. ) ...
