ORDER:- 1.

Heard learned Counsel for the applicant. The respondent husband, despite service, remained absent. 2.

The applicant is seeking transfer of A-Petition No.42/2020 filed by respondent - husband for getting divorce, from the Family Court, Akola to Civil Judge (Senior Divisoin), Ambejogai, District Beed.

It appears that applicant is not having any independent source of income and she is also having one 7 years old daughter to look after. She has also filed proceeding under Protection of Women from Domestic Violence Act against the respondent in the Court of Judicial Magistrate (First Class), Parali. Further, the distance between Akola and Parali is around 270 kms. As such, it would be highly difficult for

(2) 997 MCA-328.2022.odt the applicant to attend the dates at Akola. As such, considering the convenience of applicant, following order is passed.

ORDER

(i) The application is hereby allowed.

(ii) A-Petition No. 42/2020 is hereby transferred from the Family Court, Akola to the Court of Civil Judge (Senior Division), Ambejogai for it's disposal according to law.

(iii) The respondent is directed to appear before the learned Civil Judge (Senior Division), Ambejogai on or before 1st March, 2023.

(iv) The application is disposed of accordingly.
