Leave to amend the name of applicant. Amendment be carried out forthwith.

The applicant has approached this Court seeking regular bail in connection with FIR bearing Crime No. 341 of 2025 registered with Jawahar Nagar Police Station, Chh. Sambhajinagar for the offences punishable under Sections 78 and 351(2) of Bhartiya Nyaya Sanhita, 2023 and Sections 8 and 12 of the Protection of Children from Sexual Offences Act, 2012.

Heard the learned counsel for the applicant and learned APP for the State.

Admittedly, the alleged incident took place on 20.07.2025 and it was reported to Police Authority on 13.09.2025. On the same day, the arrest of the applicant was effected. 5.
Perusal of record indicates that the charge-sheet is filed by the Investigating Officer on 27.10.2025.

Pertinently, the Applicant and the victim have come in contact with each other through social media. Eventually, the Accused gave threats and harassed the victim. The said fact was narrated to the victim's mother leading to the lodging of the FIR. 7.
Apart from the allegations and the interaction on social media between the Applicant and the victim, there is no allegation of physical relationship between them. Moreover, the age of the victim is of 13 years while that of the Applicant is 19 years. Hence, considering the tender age of the Applicant, the impact of such prolonged incarceration needs to considered.

Since, the investigation is completed and the charge sheet has been filed, there is no further reason to continue the incarceration of the Applicant. Thus, keeping in view the peculiar facts and circumstances of the case, the right to liberty of the Applicant needs to be upheld by imposing stringent conditions. 9.
In that view of the matter, the applicant deserves to be released on bail. Accordingly, following order :-
ORDER
(I) Application is allowed.
(II) Applicant - Aditya Siddharth Patekar be released on regular bail on furnishing P.R. bond of Rs. 50,000/- (Fifty Thousand Only) with one or two local solvent sureties in the like amount, in connection with Crime No. 341 of 2025 registered with Jawahar Nagar Police Station, Chh. Sambhajinagar for the offences punishable under Sections 78 and 351(2) of Bhartiya Nyaya Sanhita, 2023 and Sections 8 and 12 of the Protection of Children from Sexual Offences Act, 2012, on the following conditions :- (a) The applicant shall attend each and every date of the Trial Court unless exempted by the Trial Court. (b) The applicant shall not enter into the jurisdiction of
-4Jawahar Nagar Police Station, till conclusion of trial. (c) The Applicant shall not pressurize the prosecution witnesses and shall not tamper with the prosecution evidence, in any manner.
(d) The applicant shall submit his Aadhar and Pan Card to the Investigation Officer and detailed addresses and phone numbers of applicant and two of the near relatives.
(e) In case of breach of any of the conditions by the applicant, it is open for the Prosecution to move this Court seeking cancellation of bail.
(III) Pending Criminal Application, if any, also stands disposed of.
