PER COURT :- Heard learned counsel for the applicants and the learned APP for the respondent-State.
The applicants are seeking bail as they were arrested in connection with FIR No.0579/2024, dated 20/09/2024, registered with Nandurbar Police Station, Nandurbar, for the offences punishable under sections 109, 132, 121(2), 324(4), 324(5), 118(1), 189(2), 191(2), 191(3), 326(F), 326(G), 125(A), 125(B), 333, 298 and 190 of Bhartiya Nyaya Sanhita, 2023, under Section 4 and 25 of Arms Act, under Section 3, 7 of Prevention of Damage to Public Property Act, under Section 3 of Criminal Law (Amendment) Act, 2013, and under Section 37(1), 37(3) and 135 of Maharashtra Police Act, 1951. The learned counsel for the applicant relies upon the order passed in Bail Application No. 1905/2024 (Lalitkumar Kamalakar Baviskar vs. The State of Maharashtra), dated 24/10/2024. The learned counsel for the applicant submits that the case against the applicant is identical to 7 of
the case of Lalitkumar (supra). The learned APP has not been able to controvert the factual assertions as contended by the applicant. In view of the above, the applications are allowed in the following terms : - a] The applicants shall be released on bail in connection with FIR No.0579/2024, dated 20/09/2024, registered with Nandurbar Police Station, Nandurbar, for the offences punishable under sections 109, 132, 121(2), 324(4), 324(5), 118(1), 189(2), 191(2), 191(3), 326(F), 326(G), 125(A), 125(B), 333, 298 and 190 of Bhartiya Nyaya Sanhita, 2023, under Section 4 and 25 of Arms Act, under Section 3, 7 of Prevention of Damage to Public Property Act, under Section 3 of Criminal Law (Amendment) Act, 2013, and under Section 37(1), 37(3) and 135 of Maharashtra Police Act, 1951, on furnishing PR bond of Rs.20,000/- with one or two sureties in the like amount to the satisfaction of the trial Court. b] The applicants, upon being released on bail, shall not contact the informant, in any manner whatsoever, during the pendency of the trial.
c] The applicants shall co-operate with the trial Court and he shall attend each and every date, unless exempted by the trial Court, for reasons to be recorded in writing. d] The applicants shall not tamper with the evidence of the 8 of
prosecution and he shall not influence the informant, witnesses and other persons concerned with the case.
e] The applicants, upon being released on bail, shall place on record of the trial Court the details of his Contact Number and residential address with updates in case of any change. Needless to say, in case of violation of any of the aforesaid conditions, the bail granted to the applicant shall be liable to be cancelled. It is also clarified that the observations made in this order are limited to the disposal of the present bail application. The concerned Court shall proceed further in the matter without being influenced by the observations made hereinabove.
The applications stand disposed of.
