Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is seeking bail as he is arrested in connection with Crime No. 383/2023 dated 13.6.2023 registered with MIDC Police Station, Jalgaon, Tq. & Dist. Jalgaon for the offence punishable under sections 302, 120-B and 34 of I.P.C.

The learned counsel for the applicant has placed reliance on the order dated 19.3.2025 in BA No. 2087/2024 in the case of Kundan Ravindra Patil Vs. The State of Maharashtra and seeks parity by submitting that considering the available record the role of the applicant is identical to what is alleged against the co-accused in above case, who has been granted bail. The learned counsel therefore seeks regular bail to the present applicant on the ground of parity. 4.

The learned APP has strongly opposed the application on the ground that principal of parity cannot be applied in this case and prays to reject the application.

Considered the above submissions and perused the record. From perusal of the statement of the eye witness, it appears that the allegations are

BA 2169/24 largely against the main accused Sachin Chavan. As regards applicant and coaccused, who has been granted bail by the above order is concerned, the role of the present applicant is similar to that of the co-accused, who has been granted bail vide above order. Considering this aspect of the matter and considering the above order passed in BA No. 2087/2025, I hold that on the ground of parity bail can be granted to the present applicant in the same terms.

O R D E R

(i) Application is allowed.

(ii) Applicant Tushar Vijay Patil be released on bail in connection with Crime No. 383 of 2023, registered with M.I.D.C. Police Station, Jalgaon, District Jalgaon, on executing Personal Bond of Rs. 15,000/- with one surety in the like amount on following conditions.

(a) The applicant shall not tamper prosecution evidence. (b) He should attend the trial on each date.

The application stands disposed of.
