Present appeal has been filed by the Insurance Company. Mr. Rohit H. Dahat, learned Advocate for the appellant - Insurance Company to whom the authority has been given by the Insurance Company, is present. He has tendered authority letter issued by the appellant - Insurance Company, which is taken on record. Mr. M. R. Deshmukh, learned Advocate for respondent No.1 - original claimant is present. The Insurance Company has arrived at a compromise with original claimant. Original claimant - Shaikh Abdul Rahim Shaikh Abdul Kadar is present. The compromise is marked as Exhibit-A.

Under such circumstance, the First Appeal stands disposed of in terms of compromise Exhibit-A.

Award be drawn up in terms of compromise Exhibit-A. 4.

Out of the amount which is deposited by the Insurance Company, an amount of Rs.1,00,000/- is allowed to be withdrawn by the Insurance Company and rest of the amount, with accrued interest, is allowed to be withdrawn by the original claimant.

Court fees be refunded as per rules.
