Heard the learned advocate Mr. Suryawanshi for the petitioner, Learned Government Pleader and the learned advocate Mr. Kadam who appears for the respondent Nos.2 and 3.

The petitioner is aggrieved by the order issued by the State Government on 29.11.2022 thereby directing the respondents Nos.1 and 2 to stop the on going election process for elections of the Group-A and Group-B Cooperative Societies through out the State at the stage at which those have reached on the date of the order till 20.12.2022 in view of the powers under Section 73-CC of the Maharashtra Co-operative societies Act. 3.

Mr. Suryawanshi submits that the election program in respect of the petitioner's Gangapur Sugar Factory is still to be published, but the respondents Nos.1 and 2 are prevented by the order dated 29.11.2022 since 1/2

925.WP.12692.22.odt only program for finalization of the voters list has been published and was to be concluded as per the notification by 06.12.2022. 4.

The learned Government Pleader and Mr. Kadam submit that this Court has already in few matters yesterday directed the respondents to resume the process from the stage it has reached with effect from 21.12.2022 and has further directed the respondent No.2 - State Cooperative Election Authority to declare the revised program in respect of each of the society by 16.12.2022. It is duty bound to publish the revised program even in respect of the petitioner's society. He can wait for such notification and the list of voters would be published by 21.12.2022. 5.

We dispose of the Writ Petition for the same reasons on the basis of which Writ Petition No.12106/2022 and connected matters were disposed of by the order dated 13.12.2022 and accept the statement of Mr. Kadam made on instructions, as an under taking to this Court.
