Heard the parties.

Learned Advocate for the applicants/petitioners informs that at the relevant time the learned Collector had not taken hearing of the petition/application and it is for the reasons he had approached this Court by way of filing this Writ Petition.

The applicants/petitioners had approached learned Collector by filing the appeal which is still pending. He has also preferred an application in the said proceedings. 4.

The learned Advocate for respondents prays for continuation of interim relief passed by this Court as the same is ex-parte.

Therefore, this Court is inclined to pass following order :

ORDER

i) The Civil Application and petition stands allowed and disposed off.

ii) The applicants/petitioners to pursue remedy before the Collector.

iii) The learned Collector to decide the pending petition/application on his file on its own merits, within six months from today.

iv) Interim relief granted earlier by this Court shall continue for two weeks from today.

v) With this the Civil Application and Writ Petition stand disposed off.
