ORAL JUDGMENT :

Consequent upon condonation of delay, this Civil Revision Application is taken up for final disposal at the stage of admission.

In this case, the Special Land Acquisition Officer has declined to accept Reference under Section 18 of the Land Acquisition Act, 1894, as there was delay on the part of the

{2} applicant in depositing the court fees.

From perusal of the order, it appears that no opportunity of hearing was offered to the applicant. The applicant is now ready and willing to pay the court fees within four weeks from today. In these circumstances, it will be only appropriate that the impugned order is set aside, subject to applicant depositing court fee amount with the concerned SLAO within four weeks from today.

The impugned order is, therefore, set aside and the SLAO is directed to make reference to the Reference Court within a period of eight weeks thereafter. If the applicant fails to deposit the court fees with the SLAO within four weeks from today, then this Civil Revision Application shall be deemed to have been dismissed, without further reference to the Court. Civil Revision Application is allowed in the aforesaid terms. There shall be no order as to costs.

All concerned to act on the basis of authenticated copy of this order.
