Learned Advocate Mr. Amar V. Lavte holding for learned Advocate Mr. S. J. Salunke submits that in view of the oral directions given by this Court, he has made inquiry in respect of order passed by this Court on 02.02.2023. The witnesses have been examined and even the statement of accused under Section 313 of the Code of Criminal Procedure has been recorded. The matter has been kept on 28.02.2023 for final arguments, so it would be about one month for the matter to be decided on merits. Under such circumstance, he submits that he has instructions to withdraw the appeal. Hence, the appeal stands disposed of as withdrawn.
