Learned Advocate Mr. Rahul Tambe appearing for the appellant, upon instructions, seeks for withdrawal of appeal. 2.

This was appeal filed by Insurance Company challenging the judgment and award passed by Tribunal in M.A.C.P. No.107/2009. Since the appellant do not want to prosecute further, the appeal stands disposed of since withdrawn.

Learned Advocate Mr. S.S. Patil appearing for original claimants would submit that by the time, respondent No.2 Priti @ Pratibha and respondent No.4 Pooja @ Pallavi got married. Therefore, he requested that the amount of their share be disbursed to them in their matrimonial name. The submission is accepted.

The Office, while disbursing the amount to respondent Nos.2 and 4 shall obtain marriage certificate or marriage invitation card and affidavit of respondent Nos.2 and 4 regarding their change in name due to marriage and then the amount be disbursed in their matrimonial name.

Since the appeal is withdrawn, the court fees refund, if any, be issued to the appellant as per rules.

The amount deposited by the Insurance Company in this Appeal be disbursed as per award with above clarification regarding disbursement to the respondent Nos.2 and 4.

Appeal is disposed of as withdrawn.
