Heard rival submissions. The respective applicants in all these applications are seeking permission to withdraw the entire compensation amounts which are deposited by the Acquiring Body in this Court. The learned counsel for the applicants pointed out order dtd.21.04.2022 in connected matters whereby this Court had allowed the applicants therein to withdraw certain amounts of compensation. In view of the same, following order is passed :
ORDER
(i) The respective applicants -claimants are hereby permitted to
withdraw 50% of the deposited amounts along with the accrued interest thereon by furnishing usual undertakings to the satisfaction of the learned Registrar (Judicial) of this Court. (ii) The applicants -claimants are further permitted to withdraw 25% of the deposited amounts along with the accrued interest thereon by furnishing solvent surety /security to the satisfaction of the learned Registrar (Judicial) of this Court. (iii) The remaining 25% amounts of the compensation shall be invested in F.D.R. with any Nationalized bank on yearly renewal basis till final disposal of this appeal.
