Heard the learned counsel for the applicant and learned APP for the Respondent-State.

Mere allegation against the applicant is that the present applicant had passed on four live cartilages to the other co-accused. The learned APP would submit that the applicant was consistently in contact with the other co-accused before and after the incident. There is strong evidence against him.

The record does not reveal the effective evidence that the applicant played a role as alleged. Why the applicant was in contact with other co-accused is a matter of trial. Considering the role attributed to the applicant and completion of the investigation against him, he deserves bail. Hence the following order :

ORDER

a) The application is allowed.

b) Applicant - Shantaram Abhiman Koli, in be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety in the like amount, in C.R.No. 331 of 2022 registered with Chopda City Police Station, District Jalgaon, for the offence punishable under Sections 302, 323, 504, 201, 120B read with Section 34 of the Indian Penal Code and under Section 3/25, 7/25, 27 of the Arms Act, on conditions that - a) The applicant shall not to contact any prosecution witnesses. b) The applicant shall attend the trial on each and effective date of hearing.
